These Terms of Service ("Terms") govern your use of kendalhill.com (the "Site") and any purchase you make from The Kendal Hill Companies ("we," "us," or "our"). By using our Site or purchasing from us, you agree to these Terms. Please read them carefully.

1. Eligibility

You must be at least 18 years old to purchase from Kendal Hill. By placing an order, you confirm that you meet this requirement. We currently deliver only within Barbados.

2. Your account

If you create an account, you're responsible for:

  • Keeping your login credentials confidential
  • All activity that takes place under your account
  • Notifying us promptly if you suspect unauthorized access

We may suspend or close any account that violates these Terms.

3. Pricing and payment

  • All prices are listed in Barbados Dollars (BBD) unless stated otherwise.
  • Prices include VAT where applicable, in accordance with Barbados law.
  • We may change prices at any time, but the price you pay is the price displayed when you place your order.
  • Shipping fees, where applicable, are added at checkout and shown before payment.
  • Payment is taken at checkout. We accept credit and debit cards through our payment provider, plus PayPal as a secondary option.

4. Orders

  • An order placed through our Site is a binding offer from you to buy. We're not obligated to accept any order.
  • We may decline or cancel an order at our discretion — for example, if a product is out of stock, has been mispriced, or if we suspect fraud or breach of these Terms. If we do so after payment, we'll refund you in full.
  • Once we ship your order, the contract between us is formed.

5. Shipping and delivery

7. Membership

  • Kendal Hill Membership is a paid subscription, offered as Annual ($99/year) or Monthly ($14.99/month) plans.
  • Memberships renew automatically at the end of each billing period until cancelled.
  • You can cancel your membership at any time from your account dashboard. Cancellation stops future renewals; benefits continue until the end of the period you've already paid for.
  • We don't offer partial refunds for unused time on an active membership.
  • Member benefits — including free shipping thresholds, member pricing, and early access — may be updated from time to time. We'll notify members of material changes with at least 14 days' notice.

8. Intellectual property

All content on kendalhill.com — including text, images, photography, logos, brand marks (Kendal Hill, Hillaby, Built in BIM), product designs, and the Site itself — is the property of The Kendal Hill Companies or our licensors and is protected by Barbados and international intellectual property laws.

You may not copy, reproduce, redistribute, modify, or use our content for commercial purposes without our prior written permission.

9. Acceptable use

When using our Site, you agree not to:

  • Use the Site for any unlawful purpose
  • Attempt to gain unauthorized access to our systems, accounts, or data
  • Scrape, copy, or systematically download our content
  • Send spam, viruses, malware, or any malicious code
  • Misrepresent your identity or impersonate any person or entity
  • Interfere with or disrupt the Site's operation

We may suspend or close accounts that violate these rules, and pursue legal remedies where appropriate.

10. Reviews and user content

If you submit reviews, comments, or other content to our Site, you grant The Kendal Hill Companies a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with our business.

You confirm that any content you submit:

  • Is your own original content (or you have permission to share it)
  • Doesn't violate anyone's rights, including privacy or intellectual property
  • Isn't unlawful, defamatory, or offensive

We may remove any content at our discretion.

11. Disclaimers

Our Site and products are provided "as is" and "as available." We make reasonable efforts to ensure accuracy of product descriptions, pricing, photography, and availability, but we don't guarantee that the Site is always available or error-free, that product descriptions are completely accurate or current, or that defects will be corrected immediately. Color representation may vary slightly between your device's display and the actual product.

12. Limitation of liability

To the maximum extent permitted by Barbados law, The Kendal Hill Companies is not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of your use of the Site or any product purchased from us.

Our total liability for any claim related to a purchase is limited to the amount you paid for that purchase. Nothing in these Terms excludes or limits our liability for fraud, gross negligence, or any liability that cannot be excluded under Barbados law.

13. Governing law and disputes

These Terms are governed by the laws of Barbados. Any dispute arising from or relating to these Terms or your use of the Site will be settled exclusively in the courts of Barbados.

14. Changes to these Terms

We may update these Terms from time to time. The current version is always posted at kendalhill.com/policies/terms-of-service with the "Last updated" date below. Material changes will be highlighted at the top of the page or notified to active customers by email. Your continued use of the Site or purchase from us after changes are posted means you accept the updated Terms.

15. Severability

If any part of these Terms is found unenforceable, the remaining parts continue in full force and effect.
